These are our terms of service. You MUST read these as by signing up for any of our products and services you are legally agreeing to them.

Consent To Store Data
By using any of 3001Webs services you are agreeing to have personal data such as name, address, email, telephone number and IP addresses used to access the site stored securely by 3001web.com for their own internal use. Your information will NOT be shared with third parties other than in the case of a request from a governmental or other authority or regulatory body, third parties we employ may, however, have access to data in order to allow us to provide our service to you. To see full details on how we handle your personal data please read our privacy policy. Please pay attention to the third-party providers section of the privacy policy to see providers we use that may have access to your data and the data of any clients on your website. Be sure to note those in your own privacy policy, for which is your sole responsibility to ensure is in place
General Client Terms
Without exception all clients of 3001Web are required when signing up for services to provide the following:
- Clients full legal name
- Company/Website or trading name
- A full, current postal address
- Valid and functioning telephone contact details
These may be checked from time to time to ensure all contact details are current and valid. If any of the above changes you should notify 3001Web.
UK DPA And GDPR
- You MUST comply with the UK Data Protection Act 2018, UK-GDPR and any other data legislation and regulations put into place from time to time by the UK, if you wish to use our web hosting services. By agreeing to these terms of service you are warranting that your business is compliant with regard to the same.
- You as a site owner and your staff MUST be aware of your responsibilities within these privacy regulations and have best practices in place.
- We provide data legislation-compliant web hosting however while we share some responsibility for your data it is not our responsibility to ensure your business is compliant.
- 3001Web will not act upon or process any of your data or the data of your client without a written request from you the data controller. This is usually done in our secure support system. Such requests will be stored for a period of 6 years, unless a deletion request in received in which case data will be removed with the exception of financial data required, which will be kept for the period permitted by law, currently 6 years.
- By agreeing to these terms of service you are authorising us to store the data relating to your site securely on our servers.
- By agreeing to these terms of service you are authorising us to remotely back up ALL your site's data including the data of your clients securely to our Google Drive account and any backup system provided by the data centres we use. These backups are for disaster recovery purposes.
- We will not use any third-party processors other than those set out in our privacy policywithout explicit consent from you the data controller.
- We will at ALL times cooperate with the Information Commissioner's Office (“ICO”) and any other government agency in the UK and any other regulatory bodies in the countries where our client's sites are located.
- We will notify the data controller (you) within 24 hours if we are made aware of a data breach on your site. We will also notify the relevant official bodies such as the ICO within 72 hours.
- We will assist clients where our time allows to facilitate requests from their customers concerning their rights as data subjects. However we reserve the right to charge for our time in respect of the same.
- We will by default design new websites with data privacy and security in mind, but the responsibility to ensure compliance remains with you.
Domain Name Registration
- You must make sure you either already own or have ordered the domain name you wish to use for yourwebsite before applying for hosting with 3001Web.
- We may with your agreement register a domain name on your behalf if requested to do so. Renewal of such domain will be your responsibility unless we are instructed, and compensated, to do this on your behalf.
- The registration and use of your domain name are subject to the terms and conditions of use applied by the relevant Registrar you must ensure that you are aware of those terms and conditions and that you comply with them.
- We shall have no liability in respect of the use of any domain name registered by you. Any dispute between you and any other person/company must be resolved between the parties concerned we will not get involved in any way. We recommend you do not register any domain that is too close to the registered trademark of any company. (EG Yahooooooooo.com) In cases of a legal dispute over a domain name, we reserve the right to suspend your hosting without giving reason until we are satisfied the dispute has been settled.
Web Site Hosting
- You represent, undertake and warrant to us that you will use the Website allocated to you only for lawful purposes and to promptly inform us if any clause or subclause of this section of our terms of service has been breached or you become aware that they may have been breached. In particular, you represent, warrant, including indemnifying us and undertake to us that:
- You will not use the Server in any manner which infringes any law or regulation or which infringes the rights of any third party, nor will you authorise or permit any other person to do so.
- You will not upload, post, link to or transmit: Any material which is unlawful, threatening, abusive, malicious, defamatory, obscene, pornographic, blasphemous, profane or otherwise objectionable in any way. Any material containing a virus or other hostile computer programme. Any material which constitutes, or encourages the commission of, a criminal offence or which infringes any patent, trademark, design right, copyright or any other intellectual property right or similar rights of any person which may subsist under the laws of any jurisdiction. Illegal Material – This includes copyrighted works, commercial audio, video, or music files, and any material in violation of any laws of the United Kingdom and the provisions of the Berne Convention and/or the Universal Copyright Convention . Warez – Includes pirated software, ROMS, emulators, phreaking, hacking, and password cracking. IP spoofing, etc., and encrypting of any of the above. It also includes any sites which provide “links to” or “how-to” information about such material. Any file that you do not own the copyright to in the first person, including mp3s, games (including mods, patches, and add-ons), free software, shareware, etc.
- You will not employ programs that consume excessive system resources, including but not limited to processor cycles and memory.
- You will not stream video directly from our servers. Any video used on your site must be hosted on an external video streaming server.
- Chat/IRC and web proxy scripts are not allowed on our network under any circumstances. Streaming media can be a drain on web server resources and as such is not allowed. CGI-based message forums that use flat file databases are often found to use excessive system resources, to avoid disappointment please use a PHP/ASP message forum. The use of webcam applications that maintain a constant FTP connection and upload images at regular intervals is forbidden.
- Files that are not related to the daily use of your website may not be stored on our servers this includes site backups. We randomly check all accounts for non-linked files using a spider. If you are storing non-related material on our server we will ask you to remove it. Refusal to cooperate may result in a service suspension.
- We reserve the right to temporarily suspend any site containing material we deem inappropriate until such times as that material is removed or you find another service provider. Our fees for hosting your website will remain chargeable. LEGAL adult content is allowed at the discretion of 3001Web, please check with us before opening your account.
- You shall keep secure any identification, password and other confidential information relating to your account and shall notify us immediately of any known or suspected unauthorised use of your account or breach of security, including but not limited to loss, theft or unauthorised disclosure of your password or other security information.
- While we take daily and monthly backups of your site, ultimately YOU will be responsible at all times for keeping your own full backup of your site including all files, folders, images and database backups where applicable.
- In the case of an individual User, you warrant that you are at least 18 years of age. We reserve the right to remove any User who we find to be in breach of this Clause.
- While we will use every reasonable precaution to ensure the integrity and security of the Servers, we can not guarantee that the Server will be free from unauthorised users or hackers, and we shall be under no liability for non-receipt or misrouting of email or for any other failure of email.
- Site backups MUST be stored either on your own devices by downloading them or stored remotely on non-3001Web servers. We perform several backups of your site, which are stored remotely. You can see details on the backups we take and how you can order extra backups here. Under NO CIRCUMSTANCES must backups of your site be stored within your hosting account, see clause 11 above.
Use Of Email Servers
- We make no representation and give no warranty as to the accuracy or quality of the information received or sent by any person via the 3001Web free email Server and we shall have no liability for any loss or damage to any data stored on the Server whatever the cause of the loss or damage.
- Our email server is provided as a free complimentary service to complement your hosting account with us. It is provided on an "As is" basis. If your business is email-critical you should have us set up professional email on a server specifically designed for that purpose independent of your website hosting. Professional email hosting is very reasonably priced and the benefits far outweigh the costs. Backing up your email data is your responsibility, not ours.
- Our free email server is shared with all our clients who choose to use it and runs from a single IP address. Should our mail server IP address be listed on any public RBL spam databases as a result of spam mail sent from our servers, we will, of course, investigate the origin of the spam, contact the offender and insist they fix the issue. In this case, we may temporarily or permanently suspend access to the email server for that client until we are satisfied that the errors or issues have been addressed. We will then apply to the RBL to delist our IP address. Delisting times are not something we can control, they can take anywhere from 24 hours to 2 weeks, depending on how long the RBL who listed us takes to remove our IP. Should our free mail server IP be blacklisted, this can affect email deliverability for all clients using the server until it is delisted. Please do not send abusive tickets to our staff. Understand that we can not monitor thousands of emails sent by many websites daily from our server. If you are concerned about this, we recommend you have us set up your email separately on a professional email. Professional email hosting is very reasonably priced, and the benefits far outweigh the costs. Using a free email server shared with others can from time to time affect email deliverability.
- You will not send bulk emails, whether opt-in or otherwise, from our network. Nor will you promote a site hosted on our network using bulk email from another network. Let us be clear on this, if you use a bulk email service, they will include the URL to your site. If enough people complain about the emails they send, and we receive spam complaints, we will have no other choice but to suspend, and potentially cancel, your email facilities pending a full enquiry.
- While we take daily backups of your email along with your site, we cannot guarantee the integrity of such backups. Backing up your email is your responsibility and not the responsibility of 3001Web or its staff.
- You shall procure that all mail is sent in accordance with applicable legislation and international anti-spam guidelines (including data protection legislation) and in a secure manner.
- If you run a mailing list it MUST be hosted remotely NOT on the 3001Web servers, and it should conform with international anti-spam laws. We highly recommend that you use a third-party service for sending out newsletters.
Use Of Images And Content
You guarantee that any text, graphics, photos, designs, trademarks, or other items you provided to 3001Web during the design of your website, or any images uploaded to your site by you or your staff are owned by you, are royalty-free or you have full permission from the copyright owner to include said content. You agree that any image or content you add to your own site is owned by you or you have permission to use it. You agree to indemnify 3001Web or any of its employees against any damages, losses, and expenses arising out of any claims or proceedings brought by a third party for the infringement of any third party's Intellectual Property Rights.
Be aware that you can NOT simply use an image you find on a search engine on your site, nor can you simply copy and paste content from another site. Both these things can be deemed as copyright theft and you may be sued by the copyright owner. Recently UK website owners were fined £5000 for using an image from Google in a blog.

Copyright Complaints
Should we receive a copyright complaint against your site we will immediately investigate. If we see that any content or images have been used without permission from the complaining parties' site, we will without notice suspend your site until such infringing material is removed.
Newsletters And Mailing Lists
- If you wish to send newsletters or have a regular members mailing list you MUST WITHOUT EXCEPTION use a third-party, legal double-opt-in mailing system, you should also obtain specific, recorded consent from the user to send them commercial mailings. This must be in line with GDPR and all other data protection regulations relevant to the audience. This MUST require a specific action from the user, pre-checked boxes are no longer acceptable.
- In all newsletters, your subscribers MUST be presented with a link to remove their email address from your list immediately. We are sorry but “reply with unsubscribe” to be removed is not acceptable, nor compliant with legislation
- Your mailing list software should record the IP address the user signed up from to safeguard you from spam complaints.
- If you choose an email provider that requires DNS zone changes to your domain such changes will be billed at our usual editing rates if we perform those changes for you.
We require that you use a third-party service for sending out newsletters. Our servers should not be used for this purpose.
Use Of Web Scripts
The use of PHP or ASP scripts is allowed on the 3001Web servers with the following conditions:
- All commercial scripts including but not limited to shopping cart scripts, CMS scripts, WordPress or other web-based programming MUST be kept up to date. Should the authors of your programme release a security update, it must be installed IMMEDIATELY or as soon as possible. 3001Web reserves the right to temporarily suspend any site using outdated or insecure scripts.
If you do not have the time or experience to do these updates yourself, please contact us. We will seek to get the upgrades done for you at our usual billing rates.
- WYSIWYG server-based scripts are not allowed at 3001Web for security purposes. There are many PC-based WYSIWYG programs available it is not necessary for this kind of program to be run on the server. This does not apply to built-in editors in programmes like Cubecart or WordPress. If you are unsure whether a program you use qualifies, please contact support.
Use Of 3001Web Software Licenses
When building websites we may use premium themes and plugins that carry yearly fees. If such plugins or themes are not listed individually on your original web design invoice then we have provided them under our developer license as a courtesy for hosting your site with us, we pay yearly for such licenses but we choose not to pass those costs on to you for certain plugins or themes. We do this to keep the cost of our web design packages down and to add value for our clients. Please be aware that unless you have purchased your own license for a premium plugin or theme it will be your responsibility to re-license should you move your site to another web host. We will, of course, provide links to the plugin or theme creator to make it easy to re-license.
Should you decide to move your site to another host you will no longer have access to our licenses as they are typically server-based licenses. To be clear you will NOT have been charged for the use of these themes or plugins up to the point of moving your site.
Backups
As part of our fully managed hosting accounts, we take regular backups of your website stored on multiple remote servers. You can see details of the backups we take here. If this is not adequate for your needs, additional backups can be provided for an additional fee.
Backups of any website must never be stored on our servers. Only files directly in use by your website should be hosted on the 3001Web servers.
If you use any backup plugins of your own, these must store the backups on a remote server and remove any temporary files created during the backup process from the 3001Web servers as soon as the backup is complete.
We offer multiple backups as a complimentary service with our managed hosting accounts, however, please be aware we cannot guarantee the integrity of any automated backup, and it is your responsibility to make sure you always have working backups of your site. There is help on that here.
Billing For Web Hosting Payments

- All charges payable by you for hosting services will be at the price of the package you chose when signing up for your account. All hosting fees MUST be paid in advance of the service being provided.
- Typically Pricing for hosting will remain at the current price for the package you chose at the time of opening your account. Prices will only increase should you decide to upgrade your package or we ask you to move to a larger account as your site grows and needs more resources. At that time you will start to pay the current fee for the upgraded account. Should you hold more than one hosting account with us each account is treated as a separate account. If you open new hosting accounts with us these are treated as separate accounts and you will need to pay the current fee for the package you choose.
- Should hosting rates increase for any particular package the new price will be applied only to any new hosting accounts opened using that package, existing hosting accounts on the package will not be affected by the price increase.*
- WITHOUT EXCEPTION ALL hosting fees should be paid on or before their due date regardless of payment method. It is the clients' responsibility to ensure payments reach 3001Web on time. Invoices for hosting are created and emailed 14 days prior to their due date. Three days before the due date we will send you a reminder email that payment is due in three days. If your invoice is not paid on time we will send reminders on the following schedule:
First overdue reminder 1 day after the due date
Second overdue reminder 3 days after the due date
Final overdue reminder 7 days after the due date- If hosting invoices are not paid within 24 hours of the final reminder your hosting account will be suspended automatically by our billing system. This will remove all access to your site and any email functionality on our servers. Suspended accounts will be reactivated automatically on payment of the outstanding invoice. Please do not treat this as a grace period it is not. Invoices are due on or before their due date. These systems are in place just in case you forget to make a payment. If you are constantly late paying invoices we may ask you to pay for your hosting yearly, add a payment card to your account or switch to Direct Debit if you are a UK, US or Canadian client.
- In the event a web hosting invoice remains unpaid 30 days after the due date, 3001Web will terminate the unpaid hosting account from our servers we will send a final email to your registered email address to warn you of this. This will include the deletion of all files, databases, emails and other data. Once data is deleted it can not be recovered.
- Paypal Payments. If your regular payment method is Paypal it is your responsibility to make sure that payments reach us on time.
- Direct Debit via GoCardless. If you have signed up with us for direct debit then your web hosting payments will be automatically requested 7 days before their due date as it often takes 5-7 days for us to receive the funds. It is your responsibility to make sure your bank account has adequate funds to cover payments to us. We will in no way be liable for any bank charges you may incur should your account not have sufficient funds available. Should you raise chargebacks against 3001Web we reserve the right to recover such fees using legal channels.
- Credit Card Payment Via Stripe. If you have signed up with us for credit card payments via stripe these will be automatically requested 7 days before their due date as it often takes 7 days for us to receive the funds after they are charged. It is your responsibility to make sure your bank account has adequate funds to cover payments to us. We will in no way be liable for any bank charges you may incur should your account not have sufficient funds available. Should you raise chargebacks against 3001Web we reserve the right to recover such fees using legal channels.
- We reserve the right to charge interest on any overdue invoices at the rate 8% per annum above the Bank of England’s base rate from time to time, and 8 % per annum for any period when that base rate is below 0%. Such interest applies to all invoices, and not just invoices under this section.
Billing For Site Editing And Work Requests
1. Site editing work performed by 3001Web staff for clients that host their sites with us will be billed by the hour in 1-minute increments with a minimum charge of 5 minutes. Site editing work performed for non-hosting clients will be billed in 30-minute increments at a higher hourly rate with a 30-minute minimum charge. You can see our current hourly editing rates on this page of our knowledge base. These fees become due immediately when tasks/edits are completed and invoiced by our staff.
2. In the case of complex projects, ongoing work for agencies or edits that take more than 7 days to complete, you will be billed at the end of each 7-day period for work completed that week usually on a Friday whether or not the project is complete. You will need to make these payments before work will continue on your site. Please be clear we bill by the hour (In varying increments depending on whether or not you host with us) not by project.
3. Any internal signing-off procedures within your company or business should not delay the payment of 3001Web invoices these are your business practices, not ours. Once a site editing invoice is created it becomes due immediately. If an invoice is not paid we will send reminder emails on the following schedule:
First overdue reminder 1 day after the due date
Second overdue reminder 3 days after the due date
Final overdue reminder 7 days after the due date
4. If site editing invoices are not paid 8 days after their due date your hosting account will be suspended automatically by our billing system. Suspended accounts will be reactivated automatically on payment of the outstanding invoice. Please do not treat this as a grace period it is NOT. Invoices are due on or before their due date. These systems are in place just in case you forget to make a payment. If you are constantly late paying invoices we may insist that you pay for editing work in advance.
5. Paypal Payments. If your regular payment method is Paypal it is your responsibility to make sure that payments reach us on time.
6. Direct Debit via GoCardless. If you have signed up with us for direct debit then your site editing payments will be automatically requested either when the work is complete or after 7 days of work should the project run more than 7 days. It is your responsibility to make sure your bank account has adequate funds to cover payments to us. We will in no way be liable for any bank charges you may incur should your account not have sufficient funds available. Should you raise chargebacks against 3001web we reserve the right to recover such fees using legal channels. We will always inform you by support ticket when we are about to request a one-off payment.
7. Credit Card Payment Via Stripe. If you have signed up with us for credit card payments via Stripe site editing payments will be charged as soon as the work is complete or at the end of each 7-day period for work completed that week for longer projects. It is your responsibility to make sure your bank account has adequate funds to cover payments to us. We will in no way be liable for any bank charges you may incur should your account not have sufficient funds available. Should you raise chargebacks against 3001web we reserve the right to recover such fees using legal channels.
Billing For Domain Registrations, Renewals Or Transfers
- Domains are registered by us on your behalf with a domain registrar. It is your responsibility to make sure any payments for renewals reach 3001Web in plenty of time.
- If you pay by credit card or direct debit renewals will automatically be billed to your card/bank it is your responsibility to inform us well in advance if you do not want to renew a domain name. Once the domain registrars have been paid they do not offer refunds under any circumstances therefore neither can 3001Web.
- All payments for domain name purchases or renewals must be made in advance. No domain names will be purchased or renewed by us unless the invoice has been paid or your account with 3001Web has enough credit to cover the renewal.
- When a domain expires, your website and any email associated with the domain will stop functioning, and no changes can be made to the domain. This is not a limitation from 3001Web it is enforced by the domain registrars.
- If you have not renewed your domain by its renewal date it will enter a Grace period of approximately 30 days to renew your domain.
- If you do not renew the domain within this grace period, it enters a redemption stage for 30 days (sometimes more) at the Registry. At this stage, the domain may be auctioned off by the upstream vendors.
- You still have the option to return the domain at this stage (if it's not auctioned off) this however will involve paying a sometimes hefty redemption fee as well as the usual renewal fee.
- If the domain is not recovered from redemption, it enters a PendingDelete stage at the Registry for 5 days. On the 6th day, the domain could be released to the public for sale.
- Paypal Payments. If your regular payment method is Paypal it is your responsibility to make sure that payments reach us in plenty of time to renew your domain this should be at least 7 days before your domain is due. We will not be held responsible for service interruption caused by domain expiry when the cause is a last-minute payment by the client.
- Direct Debit via GoCardless. If you have signed up with us for direct debit then your domain renewal payments will be automatically requested 12 days before your renewal date. This is to allow 5 days for the payment to reach us and the standard 7 days window for renewal. It is your responsibility to make sure your bank account has adequate funds to cover payments to us. We will in no way be liable for any bank charges you may incur should your account not have sufficient funds available. Should you raise chargebacks against 3001web we reserve the right to recover such fees using legal channels. We will not be held responsible for service interruption caused by domain expiry when the cause is a last-minute payment by the client. It is your responsibility to let us know well in advance if you do not intend to renew your domain name. Should you not inform us once we have paid the registrar no refunds can be given.
- Credit Card Payment Via Stripe. If you have signed up with us for credit card payments via stripe domain renewal payments will be charged no later than 14 days before your domain renewal date. It is your responsibility to make sure your bank account has adequate funds to cover payments to us. We will in no way be liable for any bank charges you may incur should your account not have sufficient funds available. Should you raise chargebacks against 3001web we reserve the right to recover such fees using legal channels. It is your responsibility to let us know well in advance if you do not intend to renew your domain name. Should you not inform us once we have paid the registrar no refunds can be given.
- Invoices for domain renewals will be sent well in advance of the renewal date.
Billing For Web Design (New Clients)
- 3001Web charges by the minute for all web designs at the same rates we charge for site editing work; we do not charge over-inflated flat rates or rounded-up hourly rates. By adopting a per-minute billing system, our clients pay only for actual time worked and not a penny more; you can see our current rates here. We will provide our best estimate on the time we think your site will take to build in our quote before work begins. Please remember, however, that these are quotes and can vary either way.
- In the case of new clients, a deposit of at least 50% of our quote will be required in order for work to begin on a new website or a rebuild of a current site.
- After the initial deposit, the client will be billed at the end of each week for work completed that week (or on project completion, whichever is sooner). This allows the completion of the project at the clients' pace without delaying payment to 3001Web or its employees.
- For work to continue to progress, these weekly invoices must be paid on time.
- Any internal signing-off processes within your company or business should not delay the payment of 3001Web invoices. These are your business practices, not ours. Once a site design/editing invoice is created, it becomes due immediately.
- Paypal Payments. If your regular payment method is PayPal, you must ensure that web design payments reach us on time.
- Direct Debit via GoCardless. If you have signed up with us for direct debit, your web design payments will be automatically requested either when the work is complete or after 7 days of work should the project run more than 7 days. You are responsible for ensuring your bank account has adequate funds to cover payments to us. We will in no way be liable for any bank charges you may incur should your account not have sufficient funds available. Should you raise chargebacks against 3001web, we reserve the right to recover such fees using legal channels. We will always inform you by support ticket when we are about to request a one-off payment.
- Credit Card Payment Via Stripe. If you have signed up with us for credit card payments via stripe web design, payments will be charged as soon as the work is complete or at the end of each 7-day period for work completed that week for longer projects. It is your responsibility to ensure your bank account has adequate funds to cover payments to us. We will in no way be liable for any bank charges you may incur should your account not have sufficient funds available. Should you raise chargebacks against 3001Web, we reserve the right to recover such fees using legal channels.
Web Design (Existing Hosting Clients)
Please see the site editing and work request payments above. Web design for existing hosting clients is billed the same way.
Web Design (Non-Hosting Clients)
- 3001Web charges non-hosting clients for design at the same rate as non-hosting site editing fees.
- In the case of new clients, a deposit of at least 50% of our quote will be required in order for work to begin on a new website or a rebuild of a current site.
- For larger projects, the client will be billed at the end of each week for work completed that week (or on project completion whichever is sooner). This allows the completion of the project at the client's pace without delaying payment to 3001Web or its employees.
- For work to continue to progress these weekly invoices must be paid on time.
- Any internal signing-off processes within your company or business should not delay the payment of 3001Web invoices these are your business practices, not ours. Once a site design/editing invoice is created it becomes due immediately.

Should you raise chargebacks against 3001web we reserve the right to recover such fees using legal channels.
Other Invoices
Should we provide you with an agreement to pay larger invoices in instalments all instalments should be paid on time and the total balance of that invoice must be paid by the due date. Our standard invoicing policies will apply to each invoice.
Accepted Payment Methods
- Credit Card via Stripe Payments. This can be used to pay any invoice. Your card will be charged immediately but please bear in mind these payments can take 4 days to reach us.
- Paypalcan be used to pay any invoice. If you don't have an account with PayPal you can still use this method and just select to pay with your credit or debit card.
- Direct Bank Transfer.UK clients only. Our bank details are listed on every invoice if you want to send us payment this way. Please use your site name and invoice number as the payment reference.
Existing clients can switch their chosen payment methods at any time just submit a support ticket to billing and ask them to take care of it for you.
Freelancer And Third-Party Payments
- 3001Web may from time to time use freelance designers and programmers to work on your site, in these cases payments for site design, custom programming, or program installation must be paid in advance of any work commencing. Where possible 3001Web will make escrow-type payments to the third party to protect the client's funds until the work has been completed to their satisfaction, at which time the designer or programmer will be paid.
- By completing and submitting an electronic order form on our site you are making an offer to purchase digital goods which, if accepted by us, is classed as a legally binding contract for services.
- If we need to buy any premium plugin or programming from a third party to complete work on your site, you will be asked to pay for that plugin/programming in advance of it being purchased and installed on your site. This kind of work will be billed separately from other work.
All payments will be in UK Pounds Sterling.
Termination And Refunds
We shall be entitled to suspend the Services and/or terminate this Agreement If you:
- Fail to pay any sums due to us as they fall due.
- Break any of these terms and conditions, which shall be determined solely by us.
- Are a company and you go into liquidation or suffer the appointment of an administrator or administrative receiver or enter into a voluntary arrangement with your creditors.
- We reserve the right to suspend the Services and/or terminate this Agreement at any time, this, however, will never be done without notice.
- Customers may cancel their accounts at any time. Hosting fees are charged on a prepaid basis. Refunds will only be offered to clients who are within their first 7 days of service under our guarantee. Refunds will only be given for the remaining days left on the hosting account. Once 7 days of service have passed for a new client no refunds can be offered.
- Domain name registration fees, charges for additional data transfer, and charges for optional extras added to your account are not refundable under any circumstances.
- Where payment has been made by credit or debit card, any refund will only be issued to the same credit or debit card.
- On termination of this Agreement or suspension of the services, we shall immediately be entitled to block access to your Website and remove all related data on our Servers.
- In the event a client company ceases to trade, all future hosting invoices will be cancelled without penalty. However, outstanding invoices for work will still be due, and the client's account will not be fully closed until all outstanding invoices are paid in full. In the event that such invoices are not paid, they will be pursued via legal means.
Services included in hosting fees
Your hosting fees are for providing and maintaining high-grade, active web hosting on the 3001Web servers. Hosting fees also include repairs to any server-related function that may not be available or become faulty and, as such, affect your site's day-to-day operation.
If you are one of our managed hosting accounts, we will also check daily for updates to WordPress core, your plugins and your theme. We will run/apply any basic updates using standard WordPress update methods free of charge as part of your hosting fees.
Should an update fail and need troubleshooting, we will bill at our usual per-minute site editing rates. In rare cases, if an update is major and requires extra time to perform, there may be an extra fee.
With all hosting accounts, we will, on request, provide Cpanel access to your account to administer your hosting account and provide a knowledge base to help you with some of the functions of the control panel. Full documentation on using Cpanel can be found on their official website.

- Providing agreed web space and bandwidth.
- Any repair or hardware replacement at the server level.
- Security hardening and monitoring of the servers.
- Your site is monitored 24/7 for connectivity. All sites hosted by 3001Web are continuously monitored by various outside services. If downtime occurs, we will be informed and work to correct any issues.
- Basic updates of WordPress core, plugins, and themes. Note that major theme updates where changes will require significant editing time may carry additional fees at our per-minute rates. Free updates only apply to existing installed themes, core, and plugins. Adding new plugins or replacing plugins abandoned by their authors/creators will incur our usual site editing fees.
- Two separate backups of your website are taken at multiple intervals for disaster recovery purposes.

Services Not included In Hosting Fees
Put very simply, any task you ask us to complete for you that is not direct maintenance to the 3001Web servers and any task you could have done yourself.
Including but not limited to:
Replacing any out-of-date/end-of-life WordPress Plugins, Installing new WordPress plugins, fixing any page or programme broken due to editing by the client or any other third party, cleaning any site that has been infected with malware, changing passwords in Cpanel, setting up or editing email addresses or passwords, site edits, sourcing of new plugins, software or images, troubleshooting connections to our mail server from third-party email software or mobile devices and fixing of any errors on your site no matter what the cause.
Unlike many hosts, we offer quality speedy, and effective support in many areas. We will do our utmost at all times to solve any issues or requests you send us relating to your site, however, this is NOT a responsibility we have to you it is an extra service.
If we can’t solve your issue, we will usually find someone who can. However, our only responsibility to you is to provide you with active web hosting space. Any other service is an additional service and is offered ONLY when our staff's time commitments allow.
You also need to understand that we do NOT offer additional support services free of charge. If our staff has to work on any part of your site whether that be something as simple as setting up an email account or a complex install of a script or programme, you WILL be billed for any time our staff gives to your online business.
A specific note on help with configuring mobile devices or third-party email software to connect to our email servers. All the details you need to connect to your email accounts are provided free of charge, if you want us to troubleshoot or support third-party email programmes or mobile devices that time will be charged at our usual rates. 99.99% of the time a client has issues connecting to email the issue is with incorrect settings in an email programme, the users' device, or port limitations set by the internet service provider, and will not be the fault of our servers. We encourage you first to seek support from the company that provides your email software or mobile device. It is really their job to support their own products. Of course, if the issue is an error with the email server that will be rectified free of charge.
To be clear we can try to help you with issues like this but the time will be charged.
To give the best value possible for hosting clients we offer a per-minute billing system for additional support and site editing services so that you only pay for the exact amount of time our staff work on your site/issue our minimum charge is just 5 minutes, not one hour. For clients who do not host with us, a higher hourly rate is charged and billed in 30-minute increments with a 30-minute minimum charge.

More detail on service not included in your hosting fees:
- Repairs to any HTML page, PHP script, CGI script, or ASP script caused by incorrect editing or modification by the client, the client's employees, or any outside service/freelancer employed by the client.
- Upgrades or replacements of ANY script/program/plugin that are forced due to changes or security enhancements in server languages including PHP, ASP, and more. The only exception to this is clients who pay for our managed WordPress hosting accounts or our updates service, in which case basic updates to WordPress core, plugins, and simple theme updates are included. Major theme, core updates or plugin replacements may carry additional fees.
- The fixing of any errors on your website, no matter what the cause. This includes any errors that may be caused by plugin or theme updates.
- The restoration of any backup of your site to a previous version.
- Editing of any HTML page, graphic, graphic, or source code requested by the client.
- Research and sourcing plugins, programmers, or images for use or work on your site.
- Installation of any program or script, automated or otherwise.
- Custom programming or modification to any script by our programmers.
- Any edits to cPanel options the client could have performed themselves, including adding email addresses or password changes.
- Any task that could have been performed by the client themselves.
- Help with configuring mobile devices or third-party software to connect to our email servers. All the details you need to connect to your email accounts are provided free of charge, if you want us to troubleshoot or support third-party email programs or mobile devices that time will be charged at our usual rates.
- Registering or renewing domain names on your behalf. The fee for this is included in the yearly price for renewal or registration.
Please note, we do not offer support for any scripts or programs purchased from or written by third parties. However, you may contact us to see if we can complete any repair, modification, or augmentation of the scripts you use.
We will quote you on this kind of work depending on the time involved. Please note that the fees you will pay for installation or modification are labour fees. If modifications or installations need to be redone again for any reason, you will be billed again.
How 3001Web support works
If you have an issue or task you need help with, you can submit a support ticket for help from our team. Telephone and live chat on various platforms are available in cases where we may need to talk to you, or you would like to talk to us. Please note, however, that all regular support regarding your site or hosting account must first be submitted via a support ticket.
We will then look at your issue/task and offer one of the following resolutions:
- We will tell you how to fix the issue yourself or point you to our knowledge base for the help you require.
- We will direct you to another website that can answer your question or offer services related to your issue.
- We will fix/correct/resolve the issue for you.
There is no charge for numbers 1 and 2. We like to help our clients learn as much as possible about running a website. This is much more beneficial for the client long-term and frees up the time of our support staff for issues that can not be corrected by clients directly.
Any work we do for you on your site will be billed at our current rates.
You will ALWAYS be informed that you will be charged for any billable work before the work begins. Please bear in mind, however, that while we can provide estimated costs for work, it is not always possible to know exactly how long a task will take. Estimates are not fixed-priced guarantees; they can vary either way.
WordPress Plugin Or Theme Issues
Our managed hosting packages include a free service to keep your plugins, themes and WordPress core up to date. To do this we simply install the latest version of a plugin or theme as per the instructions of the vendor/creator or by using standard WordPress update methods.
Should there ever be an issue with a theme or plugin update that causes your site to break, it is the author's job to support their own work. Please remember there are tens of thousands of WordPress plugins it is impossible for us to know about or support them all. We install them for you and update them for you but we cannot offer support for them. This is the responsibility of the creator of the theme or plugin to help you.
On occasions where issues occur, we may be able to disable themes and plugins to at least get your site working rather than showing an error, however, you may need to contact the author of the theme or plugin for a fix.
If time allows we may contact the author for you on your behalf. Please be aware however that any time we spend communicating with the author and applying any fixes will be billed at our site editing rates. Often it will be faster and cheaper for you to just contact whoever you purchased the theme or plugin from for a fix.
If you do want us to communicate with them for you, you will need to provide us with your login details for the author's site. Most premium plugin companies will check that you are a valid customer before offering support.
What Happens If 3001Web cannot help me with an issue or editing requirement?
Should the situation arise that we are unable to perform edits for you, we have made provisions in the knowledge base for you to find other professionals to help you with your site.
Web Design Terms

- The plan.
Before any work starts with designing any website we will first talk to you to find out exactly what you require. We will build a clear picture of what you want/need from our service.

- The quote
Based on our conversations we will provide you with a VERY detailed project plan outlining the work we will do for you and the approximate time and cost to complete that work. This may be in the form of an official quote or via a support ticket at 3001Web.
Please be aware this is a quote not a fixed price time and costs may vary slightly in either direction. We do not charge fixed fees we charge by the hour in per minute increments.
Please be aware that anything you ask us to add or do that is not listed/discussed within the original scope of the quote will incur additional charges and be invoiced separately at the end of the site build/edit. We will, of course, verify any such items with you.

- Payment
Once you have accepted our quote we will invoice you for 50% of the total amount of the estimated time, this needs to be paid before our team start working on your site. This is not refundable under any circumstances. Remember you are paying for our time, not physical products.
We will then complete all the tasks as laid out in the quote as quickly and as accurately as we can. After your initial deposit is used up in development time we will bill you each Friday for work completed that week or when the project is complete whichever is sooner. These invoices will need to be paid promptly for work to continue.

- Web Hosting
In order for us to build your site, you need first to have an active web hosting account, why? We require somewhere to build your site. As soon as we create a hosting account for you on our servers it starts using resources that we need to pay the data centres for so, unfortunately, we can not provide this free of charge.
This will be billed separately and will be due immediately.

- Domain Name
In order for us to create your web hosting account, obviously, you will need a domain name. A domain name is the yoursite.com name that points to your site. If you have this registered already somewhere else, that is fine, we will help you point your domain name to our web servers. If you do not have a domain name, we can register one for you. They are not expensive, between £9.99 and £15.99 per year depending on whether you choose .co.uk, .com or some other TLD.
This will be billed separately and not within your quote for web design.
If you already have a live site, and we are re-designing for you, then we will provide a temporary account on our development server.

- Communication
ALL communication when building/editing your site will be done by support ticket, or via a third-party app we use called Webvizio.
You can open as many support tickets as you like, but please keep it to ONE ticket per question or task, in other words, if you want changes made to three pages you would open a ticket for each page or add tasks for us at Webvizio. This, in our experience, is the FASTEST way to get things done. You submit a ticket or Webvizio task, we deal with it then we close it and we can all clearly see which tasks have been completed and which still need addressing.

- Communication Speed
We would ask that when we start building/editing your site, you check your email address for ticket or Webvizio notifications regularly. We have been known to build websites in two to three days with clients who communicate with us quickly, effectively and clearly.
Conversely, we have had sites that have taken WEEKS to build because we wait and wait for replies from the client when we have a question or need information only the client can provide.
We will not accept liability for a job not being delivered on time due to a lack of communication on your part. If the client is continuously slow to respond to requests, and we take on new jobs, those jobs WILL be given priority. We will of course finish any tasks on your site, but it may take a little longer. No discounts on fees would be offered in this case.
We get paid for our time, but we only have so much of that each week, and we have to make sure we use it wisely.

- Deadlines
Unless otherwise stipulated in our quote you can expect your site to be ready within a maximum of 14 days, we regularly complete much sooner 14 days is a worst-case scenario again this relies on fast communication from you when we have questions. However, where you delay in providing to us any information, content, images, consents or any licences we will not be responsible for any delays created as a result of the same.
Once all the work included in your quote is complete, and we have completed any small revisions you request, we will consider the project to be delivered and that job to be complete. At this point, any further work or tasks will be billed separately on a job-by-job basis.
If we reach a point where a lack of replies to our requests takes the total build time over 14 days from the day we started, we will take new jobs, which may slow down requests to finish your tasks. In these cases, we will not accept any responsibility for late delivery.

- Content
Content for all web pages will be provided to us by the client, unless copywriting is included specifically in our quote. Any logos or images provided to us by the client MUST be approved for the client's use. In other words, you MUST have licensing or the copyright owner's permission to use ANY image or asset on the pages of your site. 3001Web will not accept liability for copyright claims for images or other assets the client provides.
Any images that we provide will be fully legal and licensed stock images.
Should you wish to include text on your site from another website, even your product or service provider's website, you MUST have permission to use that text.

- Premium Plugins
When we build/edit your site we may use some premium plugins that we have purchased unlimited licenses for, including but not limited to; Beaver Builder, Beaver Themer, WP Astra Framework, Perf matters, WP Rocket, Beaver theme framework, BBQ pro firewall and others. These are provided to you free of charge under our license for as long as we are actively renewing those licenses. Should we decide to stop using a plugin in the future and cease to renew the license you are free to continue using these plugins/themes, however, you will have to purchase licenses from the plugin authors to continue to receive updates. In the case of WP rocket which will only be provided free if we build your site, we are not at liberty to offer this to hosting-only clients.
- GDPR and Data Protection Legislation
Your site will be built with data protection in mind. We will include a basic privacy policy and functionality to facilitate data information requests. Other than this, we will NOT be responsible for your approach to data protection. We are not lawyers, and you should always have your privacy policies and terms of service checked by a legal professional, we recommend K&K Legal for policy creation. All businesses online need to be aware of GDPR, and any relevant data protection legislation, you can get more information here ico.org.uk.

3001Web has a strict anti-spam policy. If we receive spam complaints about any site hosted on our cloud from an official spam organisation such as but not limited to:

that hosting account will immediately have all its outgoing email facilities suspended pending a review.
Should we discover illegal bulk mailing scripts/software on your account, your account will be terminated without refund, and we will inform the following bodies of your actions:
The payment gateway you used to pay for your hosting account.
Your internet service provider
Any local law enforcement agencies we can find based on your IP address used to open the account
Local data protection agencies to your location.
Hacker Spamming
We realise that on rare occasions some clients may use insecure PHP scripts which can get attacked by hackers who upload spamming scripts. In such cases, after disabling the site's outgoing email, the client will then be asked to do the following:
Remove or update the vulnerable PHP script from the 3001Web servers.
OR
Locate all the hackers code and remove/repair it. Then get the script patched to avoid further abuse.
If required, 3001Web staff may assist in this task subject to our usual rates.
The best advice we can give is to check the security status of any script/software before installing it to your site.
Spam Complaints From The Public
If you believe one of our clients has sent you spam, please contact us giving us as much detail as possible, and we will look into it.
Newsletter Programs / Mailing Lists
Without exception, all programs that run your mailing lists or newsletters MUST be double opt-in. By that we mean a subscriber MUST NOT be added to any mailing list unless they were first sent a confirmation email to their email address, which requires an act of confirmation to finalize their adding to the list. This is to conform with international anti-spam laws, the GDPR, the DPA and many other international data protection regulations.
Subscribers MUST be offered an automated unsubscribe link in every issue of your newsletter so that they can immediately remove themselves from your list. Where possible the mailing software you use should record the IP address the user signed up from to protect you against spam complaints.
We do not allow the hosting of bulk mailing scripts on our servers.
If you wish to run a newsletter or commercial mailing list you will need to use an external mailing provider.
LIMITS OF LIABILITY FOR WEB HOSTING SERVICES
We shall endeavour to make the server and the services available to you at all times, but we shall not, in any event, be liable for service interruptions or server downtime. 3001Web or its staff will not be responsible for any real or perceived damages that your business may suffer. We make no warranties of any kind, expressed or implied, for our hosting services. We disclaim any warranty merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by 3001Web and its employees.
The service may become unavailable for any of the following reasons:
Essential Scheduled Maintenance.
We will email you to inform you of this in advance and, where possible, schedule such work outside business hours in the country where the server is located.
Emergency Maintenance
In the case of serious security risks or imminent hardware failure, we may not be able to provide any notice, but any work will be carried out as quickly as possible.
Network Errors
These may be local to our data centres, your own neighbourhood, or any number of points in between. We have absolutely no control over these kinds of issues.
Network Attacks
While we take every possible precaution to protect against third party attacks like Denial Of Service Attacks. In extreme cases, these can temporarily take any server offline.
Hardware Failure
In the event of hardware failure, we will work to rectify any issues and replace faulty hardware as quickly as possible.
Data Breach
Should our servers ever be breached, we may need to suspend service while we investigate a breach and re-secure the server.
Security Lockouts
It is possible that some actions may trigger our security protocols, preventing IP addresses or individuals from accessing our services. In these instances please contact us by email or telephone for support.
Please be aware that servers need regular maintenance to keep running smoothly. It is always our aim at 3001Web to keep our servers as healthy and secure as they can be, while minimising any disruption as far as possible.
3001Web will not be liable to you or any third party for damages, real or perceived for but not limited to; data loss, losses in profits, losses in advertising spend, lost savings, or other incidental, consequential, or special damages, as a result of our servers not being available due to planned maintenance, emergency maintenance, hardware or network failures or any other interruption to the service.
The maximum compensation we would ever offer to you, at our discretion, will not exceed a daily pro rata hosting refund covering the period the service is unavailable. This will not be applicable in the event you trigger a firewall on our servers when trying to access your site, or our server security blocks what it considers to be suspicious or potentially dangerous traffic.

This applies to hosting clients on 3001Web managed hosting or external clients who pay for our WordPress updates and maintenance service. We check all sites using these services daily for any available updates to WordPress core or any themes and plugins the client may use via our automated maintenance systems. If updates are available they are run in the same way they would be had the client clicked update from their WordPress admin area.
In the event that an error in an update occurs that causes a website or any particular functionality to break, whether that issue is caused by the automation process or errors in coding from a third-party plugin or theme updates 3001Web or its employees will not be liable to you or any third-party for damages, real or perceived for but not limited to; email data loss, lost orders, losses in potential profits, losses in advertising spend, lost savings or other incidental, consequential or special damages, as a result of the faulty update. You may of course contact us to fix your website but this will be billed at our usual rates.
LIMITS OF LIABILITY For Use of our Email Servers
We make no representation and give no warranty as to the accuracy or quality of the information received or sent by any person via the 3001Web email Server, and we shall have no liability for any loss or damage to any data stored on the Server, whatever the cause of the loss or damage may be.
Our email service is provided as a free service to complement your hosting account with us. It is provided on an “As is” basis. If your business is email-critical, you should have us set up professional email on a server specifically designed for that purpose, independent of your website hosting. Professional email hosting is very reasonably priced, and the benefits far outweigh the costs. Backing up your email data is your responsibility, not ours.
3001Web will not be liable to you or any third party for damages, real or perceived for but not limited to; email data loss, lost orders, losses in potential profits, losses in advertising spend, lost savings, or other incidental, consequential or special damages, as a result of using our email server.
LIMITS OF LIABILITY Domain Registration Or Renewal
Our domain registration/renewal service is provided as an extra service to complement your hosting account with us. We charge a small fee for this service, which is added to the cost of the yearly renewals. This covers our staff manually renewing your domain on your behalf.
ALL domain renewals MUST be paid for in advance. We will not renew or register any domain unless we have received a cleared payment. You are responsible for making sure payment reaches us at least 7 days before your domain expires. Once registered/renewed domains, payments are non-refundable. Domain registrars do not offer refunds, so neither can 3001Web.
3001Web will not be liable to you or any third party for damages, real or perceived, for but not limited to loss of domain name, email data loss, lost orders, losses in profits, losses in advertising spend, lost savings or other incidental, consequential or special damages, as a result of using our domain registration service.
LIMITS OF LIABILITY Functionality Of Your Website
3001Web or its employees are not responsible for making sure every function of your website is working correctly at all times. It is YOUR responsibility as the site owner to monitor and regularly check any and all of the functionality of your website.
The nature of WordPress websites means your site programming will be updated regularly by many different parties who author, the core programming, plugins, and themes that power your site. In the case of managed hosting it is our responsibility to install updates from these third parties when they are made available to us, it is not our responsibility to check the programming is still functioning after the update.
Be aware that at all times you are responsible for the monitoring of the functionality of your own site. We do offer services to repair any broken functionality only if and when you inform us of errors and where our time allows.
Miscellaneous
Severance - In the event that one or more clauses in these terms is found to be unlawful, invalid or otherwise unenforceable those clause(s) shall be deemed severed from the remainder of these terms The remainder of these terms shall be valid and enforceable.
Law and jurisdiction – These terms (including any non-contractual matters and obligations arising therefrom or associated therewith) shall be governed by, and construed in accordance with, the laws of England and Wales. Any dispute, controversy, proceedings or claim between you and us relating to these terms (including any non-contractual matters and obligations arising therefrom or associated therewith) shall fall within the jurisdiction of the courts of England and Wales.
Relationship - Nothing in these terms shall constitute or be deemed to constitute a partnership, joint venture, agency, or other fiduciary relationship between the Parties other than the contractual relationship expressly provided for in these terms.
Third Party Rights - Unless expressly stated otherwise, no part of these terms is intended to confer rights on any third parties, and accordingly, the Contracts (Rights of Third Parties) Act 1999 shall not apply to these terms.
